RESUMEN: En el presente artículo se intentará demostrar que la libertad de conciencia y religiosa conforman un único derecho que tienen como fin proteger las creencias e ideologías de las personas, independientemente de su carácter religioso o secular. Por ende, se sostendrá que la fórmula adoptada por el sistema jurídico colombiano de promover el fenómeno religioso es contraria al principio de igualdad porque privilegia una visión del mundo teísta frente a otras visiones, también válidas en un Estado constitucional y pluralista (...) como el colombiano.ABSTRACT: In this article we will try to demonstrate that the freedom of conscience and religion constitute a single right that have as a purpose to protect the beliefs and ideologies of people, regardless of their religious or secular character. The purpose of this study is to determine empirically the state of the art of the medical care, when healthcare personal is confronted with ethical dilemmas related with the care they give to the geriatric population. An observational, longitudinal, prospective and qualitative study was conducted by analyzing the correlation between healthcare personnel–patient relationship, and ethical judgments regarding dilemmas that arise in daily clinical practice with geriatric patients. Mexican healthcare personnel with current active practices were asked to write up an ethical (...) dilemma that arose frequently or that had impacted their medical practice. From the narrative input, we were able to draw up a database with 421 dilemmas, and those corresponding to patients 60 years and older were selected. The axiological analysis of the narrative dilemmas of geriatric patients was made using dialectical empiricism. The axiological analysis values found most frequently were classified into three groups: the impact of healthcare, the roles of the physician, and refusal of therapy; the healthcare role of educator, caring for the patients’ life and the risk of imminent death where the values found more often. The persistence and universality of certain dilemmas in geriatrics calls for awareness and requires a good training in the ethical discernment of these dilemmas. This would help to improve substantially the care and the life quality of this population. (shrink)

Lower extremity non-contact soft tissue injuries are prevalent in elite futsal. The purpose of this study was to develop robust screening models based on pre-season measures obtained from questionnaires and field-based tests to prospectively predict LE-ST injuries after having applied a range of supervised Machine Learning techniques. One hundred and thirty-nine elite futsal players underwent a pre-season screening evaluation that included individual characteristics; measures related to sleep quality, athlete burnout, psychological characteristics related to sport performance and self-reported perception of chronic (...) ankle instability. A number of neuromuscular performance measures obtained through three field-based tests [isometric hip strength, dynamic postural control and lower extremity joints range of motion ] were also recorded. Injury incidence was monitored over one competitive season. There were 25 LE-ST injuries. Only those groups of measures from two of the field-based tests, as independent data sets, were able to build robust models [area under the receiver operating characteristic curve score ≥0.7] to identify elite futsal players at risk of sustaining a LE-ST injury. Unlike the measures obtained from the five questionnaires selected, the neuromuscular performance measures did build robust prediction models. The inclusion in the same data set of the measures recorded from all the questionnaires and field-based tests did not result in models with significantly higher performance scores. The model generated by the UnderBagging technique with a cost-sensitive SMO as the base classifier and using only four ROM measures reported the best prediction performance scores. The models developed might help coaches, physical trainers and medical practitioners in the decision-making process for injury prevention in futsal. (shrink)

Latin American and Latinx philosophers have a long and rich history of deep engagement in public life through a variety of different projects and venues. This chapter offers a brief survey of the historical development and practice of philosophy in public life in Latin American and Latinx traditions. Because of their unique histories, it engages public philosophy in Mexico and Argentina separately. The chapter shows that a guiding thread in Argentinian public philosophy is a deep‐rooted concern about the threats created (...) by political and intellectual authoritarianism and strategies for pushing back against this oppression by developing emancipatory practices and democratic alternatives. This work runs through a long line of Argentinian philosophers from José Ingenieros and Alejandro Korn to María Lugones and Diana Maffía. Public philosophy is clearly a vibrant and ongoing enterprise in contemporary Mexico. Argentina also possesses a long and rich tradition of public philosophy. (shrink)

'We desire all and only those things we conceive to be good; we avoid what we conceive to be bad.' This slogan was once the standard view of the relationship between desire or motivation and rational evaluation. Many critics have rejected this scholastic formula as either trivial or wrong. It appears to be trivial if we just define the good as 'what we want', and wrong if we consider apparent conflicts between what we seem to want and what we seem (...) to think is good. In Appearances of the Good, Sergio Tenenbaum argues that the old slogan is both significant and right, even in cases of apparent conflict between our desires and our evaluative judgements. Maintaining that the good is the formal end of practical inquiry in much the same way as truth is the formal end of theoretical inquiry, he provides a fully unified account of motivation and evaluation. A implementação de tecnologias móveis de informação e comunicação no suporte à Saúde Mental tem atraído a atenção das autoridades. Com a ascensão das Inteligências Artificiais, esse movimento pode ser impulsionado de maneira exponencial. Nesse cenário, esta revisão tem como objetivos verificar a aplicabilidade das Inteligências Artificiais (IAs) na Saúde Mental e analisar os aspectos que favorecem a relação entre IAs e usuários. Para tanto, realizou-se uma revisão sistemática nas bases de dados PubMed e Biblioteca Virtual em Saúde, no período (...) de 25 de maio a 23 de junho de 2023. Selecionamos os 100 primeiros artigos mais relevantes com as palavras-chave: “Inteligência Artificial”, “Saúde Mental”, “Chatbots”, “Psicoterapia”, “Psicologia” e suas equivalentes em inglês. Os critérios de inclusão foram: acesso aberto, publicação a partir de 2018, em português ou inglês e menção à atuação de IAs no âmbito da Saúde Mental. Para reduzir o risco de viés, excluímos os estudos que não mensuraram o impacto das intervenções por meio de métodos experimentais ou quase-experimentais. Para a síntese dos dados, delimitaram-se alguns pontos específicos de análise, como “Resultado da intervenção”, “Aspectos que favorecem a relação”, entre outros. Atenderam aos critérios de inclusão 24 estudos, dos quais 17 apresentaram resultados positivos em suas intervenções. O uso de IAs na Saúde Mental possui grande potencial de expansão e os resultados obtidos neste trabalho podem guiar a implementação dessas práticas e futuras pesquisas na área. (shrink)

This paper deals with the question of whether uncertainty regarding model structure, especially in climate modeling, exhibits a kind of “chaos.” Do small changes in model structure, in other words, lead to large variations in ensemble predictions? More specifically, does model error destroy forecast skill faster than the ordinary or “classical” chaos inherent in the real-world attractor? In some cases, the answer to this question seems to be “yes.” But how common is this state of affairs? Are there precise mathematical (...) results that can help us answer this question? And is dependence on model structure “sensitive” in that arbitrarily small errors can destroy forecast skill? We examine some efforts in the literature to answer this last question in the affirmative and find them to be unconvincing. (shrink)

An effective method to increase the number of potential cadaveric organ donors is to make people donors by default with the option to opt out. This non-coercive public policy tool to influence people’s choices is often justified on the basis of the as-judged-by-themselves principle: people are nudged into choosing what they themselves truly want. We review three often hypothesized reasons for why defaults work and argue that the as-judged-by-themselves principle may hold only in two of these cases. We specify further (...) conditions for when the principle can hold in these cases and show that whether those conditions are met is often unclear. We recommend ways to expand nationwide surveys to identify the actual reasons for why defaults work and discuss mandated choice policy as a viable solution to many arising conundrums. (shrink)

In this paper we advance a new solution to Quinn’s puzzle of the self-torturer. The solution falls directly out of an application of the principle of instrumental reasoning to what we call “vague projects”, i.e., projects whose completion does not occur at any particular or definite point or moment. The resulting treatment of the puzzle extends our understanding of instrumental rationality to projects and ends that cannot be accommodated by orthodox theories of rational choice.

Definiciones de epistemología hay muchas, al igual que clases y estilos. Sin embargo, más allá de esta diversidad, es necesario contar con una definición básica que guíe nuestra comprensión del tema. Dos serán las preguntas que nos ayuden a ello en este artículo: a) ¿qué es la epistemología? y b) ¿para qué le sirve al científico?

Argumentation represents a way of reasoning over a knowledge base containing possibly incomplete and/or inconsistent information, to obtain useful conclusions. As a reasoning mechanism, the way an argumentation reasoning engine reaches these conclusions resembles the cognitive process that humans follow to analyze their beliefs; thus, unlike other computationally reasoning systems, argumentation offers an intellectually friendly alternative to other defeasible reasoning systems. LogicProgrammingisacomputationalparadigmthathasproducedcompu- tationallyattractivesystemswithremarkablesuccessinmanyapplications. Merging ideas from both areas, Defeasible Logic Programming offers a computational reasoning system that uses an argumentation engine (...) to obtain answers from a knowledge base represented using a logic programming language extended with defeasible rules. In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

I argue that Husserl’s concept of position-taking, Stellungnahme, is adequate to understand the idea of second nature as an issue of philosophical anthropology. I claim that the methodological focus must be the living subject that acts and lives among others, and that the notion of second nature must respond to precisely this fundamental active character of subjectivity. The appropriate concept should satisfy two additional desiderata. First, it should be able to develop alongside the biological, psychological, and social individual development. Second, (...) it should be able to underlie the vast diversity of human beings within and across communities. As possible candidates, I contrast position-taking with two types of habit-like concepts: instinct and habitus, on the one hand, and customary habits, on the other. I argue that position-taking represents the active aspect of the subject while the habit-like concepts are passive. A subject’s position-takings and ensuing comportments are tied together by motivations, which evince a certain consistency, and for this reason are expression of the subject’s identity. I conclude by nuancing the relation between Stellungnahme and passivity. Passivity is deemed necessary to action but subservient to it; position-taking is thought to be prior to passivity. (shrink)

It is undeniable that human agents sometimes act badly, and it seems that they sometimes pursue bad things simply because they are bad. This latter phenomenon has often been taken to provide counterexamples to views according to which we always act under the guise of the good. This paper identifies several distinct arguments in favour of the possibility that one can act under the guise of the bad. GG seems to face more serious difficulties when trying to answer three different, (...) but related, arguments for the possibility of acting under the guise of the bad. The main strategies available to answer these objections end up either undermining the motivation for GG or failing to do full justice to the nature of perverse motivation. However, these difficulties turn out to be generated by focusing on a particular version of GG, what I call the “content version”. But we have independent reasons to prefer a different version of GG; namely, the “attitude version”. The attitude version allows for a much richer understanding of the possibility of acting on what we conceive to be bad. Drawing on an analogy with theoretical akrasia and theoretical perversion, I try to show how the attitude version can provide a compelling account of perverse actions. (shrink)

This paper argues that the principles of instrumental rationality apply primarily to extended action through time. Most philosophers assume that rational requirements and principles govern in the first instance momentary mental states, as opposed to governing extended intentional actions directly. In the case of instrumental rationality, the relevant mental states or attitudes would typically be preferences, decisions, or intentions. In fact, even those who recognize the extended nature of our agency still assume that rational requirements apply primarily to mental states (...) at a moment in time. Such views try to do justice to the extended nature of our agency by postulating rational requirements that apply in the first instance to plans, policies, and intentions more generally. The paper focuses on the central case of requirements and reasons governing the reconsideration of intentions and argues that these requirements or reasons are either superfluous or invalid.I argue that a proper conception of instrumental reasoning that applies directly to actions turn out to have surprising consequences. In fact, this conception allows us to see that policies, projects and the like are best understood as instances of extended actions, and that the instrumental requirements that apply to projects and policies are exactly the same as the instrumental requirements that apply to ordinary extended actions. Finally, I argue that the resulting theory of instrumental rationality is a significant improvement over theories that rely on principles governing intentions. (shrink)

Unresponsive wakefulness syndrome (UWS, previously known as vegetative state) occurs after patients survive a severe brain injury. Patients suffering from UWS have lost awareness of themselves and of the external environment and do not retain any trace of their subjective experience. Current data demonstrate that neuronal functions subtending consciousness are not completely reset in UWS; however, they are reduced below the threshold required to experience consciousness. The critical factor that determines whether patients will recover consciousness is the distance of their (...) neuronal functions from this threshold level. Recovery of consciousness occurs through functional and/or structural changes in the brain, i.e., through neuronal plasticity. Although some of these changes may occur spontaneously, a growing body of evidence indicates that rehabilitative interventions can improve functional outcome by promoting adaptive functional and structural plasticity in the brain, especially if a comprehensive neurophysiological theory of consciousness is followed. In this review we will focus on the pathophysiological mechanisms involved in UWS and on the plastic changes operating on the recovery of consciousness. (shrink)

This article tries to establish the scopes and limits of the main interpretations on Newton during the 20th century, highlighting on the one hand the textual evidence at disposal, and on the other hand the philosophical and epistemological currents that defines the main features of those interpretations. It will be shown that the rejection of positivism is not sufficient condition for establishing an adequate interpretation and, together with the strengthening of the research from Newton’s manuscript, it is necessary a wider, (...) and more detailed model that those established by some of the most outstanding scholars like Alexandre Koyré, I. In trying to explain the possibility of akrasia , it seems plausible to deny that there is a conceptual connection between motivation and evaluation ; akrasia occurs when the agent is motivated to do something that she does not judge to be good . However, it is hard to see how such accounts could respect our intuition that the akratic agent acts freely, or that there is a difference between akrasia and compulsion. It is also hard to see how such (...) accounts could be extended to the realm of theoretical reason, but this is generally not taken Ito be a problem, because it is generally assumed that there is no similar phenomenon in the realm of theoretical reason. This paper argues that there is such a thing as theoretical akrasia, and that we can find a characterization of this phenomenon in Descartes’s Meditations. Drawing on certain passages in the Meditations, we can construct an account of theoretical akrasia; this account can then be adapted to resolve the original problem of akrasia in the realm of practical reason. The account asserts that there is a conceptual connection between motivation and evaluation in free action; it also enables us to show how the akratic agent is still acting freely when he does something that he does not judge to be the best all things considered. The practice of parkour in urban spaces by young people, especially those who call themselves traceurs, illustrates how identities are formed in an ephemeral way by reinterpreting spaces in the city – briefly and without leaving a trace. However, in a sort of paradox, these interventions are registered in the socio-digital spectrum, tokenistically anchoring and incorporating them into conversations and social interactions. This work aims to explain the practice of the sport called parkour as a socio-semiotic phenomenon. We have used (...) some zones of Mexico City as a specific case for our approach. The foregoing leads to the conclusion that the meaning of parkour goes beyond its recreational role and places it as a relevant piece of identity for excluded urban social groups – even though these practices have been appropriated by marketing strategies. Our approach will use a cultural semiotics perspective, as well as direct observations and interviews as research techniques. (shrink)

The COVID‐ 19 pandemic is a critical test for the already overburdened and mostly underfunded public healthcare systems of Latin America. In a region that suffers from severe inequalities, public healthcare systems are the only source of medical care for a large sector of the population who work in the informal economy or are unemployed. State‐run hospitals and clinics are already overstressed by continuous demand for treatment of vector‐borne diseases and community‐acquired infections as well as high rates of non‐communicable diseases. (...) Ideological misconceptions and denial among Latin America’s political leaders prevented timely preparations for the pandemic and added to chronic governance problems. As ethical expertise in Latin America focuses on research ethics, few hospitals in the region have functioning clinical ethics committees or clinical ethics policy, forcing healthcare personnel to make excruciating treatment decisions in an environment dominated by material scarcity and public distrust. This essay examines the emergence of COVID‐19 in Latin America and the serious challenge that it poses for Latin America's public healthcare systems. (shrink)

This paper uses the well-known Three Prisoners Paradox to examine the impossibility of maintaining noninformativeness throughout hierarchization. The Paradox has been solved by Bayesian conditioning over the choice made by the Warder when asked to name a prisoner who will be shot. We generalize the paradox to situations of N prisoners, k executions and m announcements made by the Warder. We then extend the consequences of hierarchically (...) placing uniform and symmetrical priors for the probability p of the Warder naming Prisoner B, say. We prove that breaks of indifference and neutrality caused by assignment of uniform and symmetrical priors in lieu of degenerate indifference probabilities hold in general. The main purpose of this thesis is to explore de Finetti's ideas and contributions to decision theory. Such ideas are not as well-known as his work on probability. ;The first part of the work is placed in a unisubjective decision-making context. It starts by including a discussion on predictivism, an approach to statistics which de Finetti insisted on and which has only recently been rediscovered and advocated. ;The second part is placed in the context of group, or multisubjective, decision-making. This (...) area is well-known for its negative results, starting with Arrow's impossibility theorem. While being aware of such difficulties, de Finetti made important contributions to this field, which he saw as the appropriate context to approach basic concepts such as "objectivity" and Wald's admissibility theorem. Such concepts, together with exchangeability, illuminate the Bayesian position by also making connection with the non-Bayesian approach. ;The last part of the work starts with a critical discussion of classical methods which are unacceptable for Bayesians. Se analizan los textos de Rafael Gutiérrez-Girardot sobre F. Nietzsche en torno a la tragedia y el pesimismo. Esta aproximación se elabora a partir de tres temas: estilo, nihilismo y estética. Se argumenta que la interpretación de Gutiérrez-Girardot sobre Nietzsche impide que este sea visto solo como un crítico literario. Asimismo, este trabajo brinda el tono a la escritura de Rafael Gutiérrez Girardot y, de este modo, configura su estilo personal.

Constitutivists have tried to answer Enoch’s “schmagency” objection by arguing that Enoch fails to appreciate the inescapability of agency. Although these arguments are effective against some versions of the objection, I argue that they leave constitutivism vulnerable to an important worry; namely, that constitutivism leaves us alienated from the moral norms that it claims we must follow. In the first part of the paper, I try to make this vague concern more precise: in a nutshell, it seems that constitutivism cannot (...) provide an adequate account of the relation between the constitutive norms of agency and the particular ends the agent pursues. I then provide a broad outline of an interpretation of Kant’s formalism that is immune to this objection. I conclude that constitutivism is best understood as the upshot of a formalist view of categorical practical principles. (shrink)

The idea of direction of fit has been found appealing by many philosophers. Anscombe’s famous examples have persuaded many of us that there must be some deep difference between belief and desire that is captured by the metaphor of direction of fit. Most of the aim of the paper is to try to get clear on which intuitions Anscombe’s example taps into. My view is that there is more than one intuition in play here, and I will try to show (...) that various distinctions and points are confused in the literature on direction of fit. But I also want to argue that once the proper distinctions are made, it’s not clear that the notion of direction of fit can do any of the philosophically significant work that it was supposed to do. I first argue that the best way to unpack the notion of direction of fit would indeed be by means of the constitutive relation between truth and belief. In particular, the notion of direction of fit is best understood as different ideals, or formal ends, guiding the inference, from what I call “prima-facie” attitudes to what I call “all-out” attitudes respectively in the theoretical and practical realm. However, I’ll argue that there’s no non-circular way of making this distinction. But even if no definition of “belief” and “desire” come out of the distinction between directions of fit, it does elucidate the different natures of practical and theoretical enquiry. However, understood this way, the notion of direction of fit does not seem to capture the distinction illustrated by Anscombe’s example. I try to argue in the last section that Anscombe’s compelling example is best explained not by a distinction between directions of fit, but by a distinction between two different inferential mistakes: one from general to general or particular to general, and the other from general to particular. There’s an important asymmetry between practical and theoretical endeavours in this neighbourhood. However, noticing this asymmetry will also fail to deliver the philosophical payoffs that the notion of direction of fit was supposed to have. (shrink)
